The New York State Attorney General's Office Real Estate Finance Bureau is charged with enforcing Article 23-A of the General Business Law (the “Martin Act”).

They govern regulations and regulate the offer and sale of real estate securities, including:

  • Cooperative interests in realty
  • Syndications
  • Intrastate offerings

You can make a complaint about:

  • Developers or sponsors of condos
  • Co-ops
  • Homeowner's associations
  • Timeshares

The Bureau does not review complaints about:

  • Boards of cooperatives
  • Condos
  • Homeowners' associations
  • Construction defects in a single unit
  • Operations of Mitchell-Lama cooperatives
  • Disputes between a property owner and tenant
  • Timeshares located and purchased outside of New York State

Broker-dealers of real estate securities must register with the Attorney General.

This must be before taking part in:

  • Offers
  • Sales
  • Advertising
